Marketleap Terms of Service

1. Marketleap accepts, and submits URLs for inclusion in Inktomi's, FAST's, Overture's, and other Search Partner's (collectively, "Search Partners) web databases. Additionally, Marketleap provides an "Account Management" area for monitoring, maintaining and adding URLs from one or more domains for customers in good standing.
   
2. You acknowledge that Marketleap and/or one of its Search Partners, may remove any URL from Search Partner's index for reasons including, without limitation, the following:
1. Is illegal;
2. Is a fraudulent use of the Service, as determined by a Search Partner in its sole discretion;
3. Infringes the rights of a third party (as determined by a Search Partner in its sole discretion);
4. A Search Partner and/or Marketleap receives a notice of an act of copyright infringement in compliance with the notice requirements of the Digital Millennium Copyright Act of 1998;
5. Must be removed in response to a court order or other judicial or governmental request or action;
6. Does not comply with Marketleap's editorial standards;
7. The use of text that is hidden from the user
8. Pages that give the search engine a different page than the public sees (cloaking)
9. Excessively cross-linking sites to inflate a site's apparent popularity
10. Multiple sites offering the same content
11. Pages that seem deceptive, fraudulent or provide a poor user experience
12. Does not comply with a Search Partner's technical standards and/or requirements.
• You acknowledge and agree that you shall not submit any URL that does not comply with (a), (b) or (c) above.
  
• Disclaimers and limitations on liability
  Marketleap shall not be responsible for URLs dropped or excluded by Search Partner for any reason.
  Marketleap shall make no refunds for dropped or excluded URLs that are determined to be non-compliant with section 2 above.
  
• Marketleap shall not be responsible for delays or failure of performance resulting from Internet Service Provider delivery problems or failure, or any communication or delivery problems associated with Client's receipt of the Account Management data. Marketleap shall not be responsible for acts or causes beyond its control, including but not limited to: acts of God, strikes, lockouts, communications line or equipment failures, power failures, earthquakes, or other disasters.
  
• Marketleap does not represent or warrant that Customers URLs will achieve a favorable position, or any position, within a Search Partner's search index.
  
• Marketleap does not warrant or represent that the use or the results of the use of the materials available through the Marketleap Service or from third parties will be correct, accurate, timely, reliable or otherwise.
  
• You expressly agree that use of the Marketleap Service is at your sole risk. The Marketleap Services is provided on an "as is" and "as available" basis. Marketleap expressly disclaims all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement.
  
• Notwithstanding the security precautions taken against disclosure of information, there are certain conditions that exist on the Internet generally which are outside Marketleap's control and could result in a breach of security. Accordingly, Marketleap cannot guarantee that Your Account Management data information will be free from corruption or piracy. You hereby expressly waive any claim against Marketleap arising out of the loss of data through piracy, breach of security or for any other reason.
  
• To the maximum extent allowed by law, Marketleap and any of its members, subsidiaries, affiliates, service providers, licensors, officers, directors or employees shall not be liable for any direct, indirect, special, incidental or consequential damages (no matter how they arose, including negligence), or for interrupted communications, lost data or lost profits, arising out of or in connection with the Marketleap Service. Further, Marketleap will not have any liability for any losses arising because its Service is not operational or accessible. This section does not limit liability for bodily injury of a person. Some states do not allow limitations on incidental or consequential damages, so the above limitations may not apply in certain circumstances.
